BetaTerms of Service
Effective October 29, 2026 Version 2026-10-29
The short version
- DapApp is a beta: free to use, still being built, and with no promise of uptime or support.
- It’s for teams and families: businesses, organizations and households. You must be 18 or older and in the United States, and allowed to act for the organization if you sign up for one.
- Your data stays yours. We use it to run DapApp for you, not to sell or advertise.
- Don’t misuse it, and don’t make it your only record for anything safety-critical.
- Our liability is limited, and any dispute is governed by Arkansas law.
This summary is here to help you read the rest. If it ever differs from the sections below, the sections below are what counts.
Who we are
In shortThese terms are a contract between you and the company that runs DapApp.
These Terms of Service (the “Terms”) are an agreement between you and SPRAYGENIX, LLC, an Arkansas limited liability company (“DapApp”, “we”, “us”). By creating an account or using DapApp, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use DapApp.
DapApp is a daily activity planner for teams. It lets people plan tasks, people, places and time off in one shared schedule.
Who can use DapApp
In shortAdults in the US, for a business, an organization or a household.
You must be at least 18 years old and located in the United States. You can use DapApp for a business or organization, or to organize your own household or family.
The person who signs up is responsible for everyone they add. Anyone you add as a user must be at least 13 years old, and you must not add personal information about a child under 13 as a user. If you add family members, you confirm that you are their parent or guardian or that they have agreed to be added.
If you sign up for, or use DapApp on behalf of, a company or organization, you confirm that you have the authority to bind it to these Terms. In that case “you” includes that organization.
The beta
In shortIt’s early. It might break, change or go away, and we can’t promise support.
DapApp is currently in beta. It is provided for evaluation and early use. Features may be added, changed, limited or removed at any time, and the service may be interrupted, slow or unavailable.
We make no commitment to uptime, support, response times, or to keep any feature or data available. Access may be limited or invite-only, and we may pause, restrict or end the beta or any account at any time.
Keep your own copy of anything important. We may reset or remove beta data, and we will give notice first where we reasonably can.
Do not rely on DapApp as the only record or system for anything where a missed or wrong schedule could cause injury, damage to property or a legal violation, such as medical care, emergency response or safety-critical work.
Your account
In shortKeep your login safe. You’re responsible for what happens under it.
Give us accurate information and keep it up to date. Keep your password confidential, and don’t share your login. Tell us promptly at [email protected] if you think someone else has used your account.
Company owners and administrators decide who is invited, what each person can see and do, and when someone is deactivated. You’re responsible for activity under your account, and your company is responsible for the people it adds.
Your data
In shortYou own what you put in. We only use it to run DapApp for you.
You own it. The schedules, tasks, notes, names, addresses and other information you or your team put into DapApp (“Your Data”) belong to you or your company. We don’t claim ownership.
We can use it to run the service. You give us a limited, worldwide, non-exclusive license to host, copy, back up, display and process Your Data solely to provide, secure, support and improve DapApp for you, and to show it to the people you choose to share it with. We may also use information that is combined or de-identified so it can’t reasonably be tied to you or your company to understand and improve the service.
You’re responsible for it. You promise that you have the right to put Your Data into DapApp, including information about your staff and customers, and that doing so follows the law and any promises you’ve made to them. Please don’t enter sensitive information such as health records, payment card or bank numbers, or government ID numbers.
How we handle personal information is described in the Privacy Policy.
If you’re a business
In shortFor your team’s data, we work for you: only on your instructions, never to sell it.
When a company puts personal information about its staff or customers into DapApp, we act as the company’s service provider (processor). We will: process that information only to provide DapApp to the company and on its documented instructions; not sell it or share it for advertising; keep it confidential and secured as described in the Privacy Policy; limit access to people who need it; use the service providers listed in the Privacy Policy and keep them to terms at least as protective; help the company respond to privacy requests; tell the company without undue delay if we learn of a security breach affecting it; and delete or return the information when the account closes, as described in “Ending things”. The company confirms it has the right to give us this information and has told the people concerned. Ask for a signed data processing addendum at [email protected].
What you agree not to do
In shortDon’t break the law, break the service, or break into things.
- Use DapApp to break any law or anyone’s rights.
- Access, probe or test DapApp or other people’s data without permission, or bypass any limit or security feature.
- Overload, disrupt or scrape the service, or use automated tools to access it except as we allow.
- Upload malicious code, or content that is unlawful, harassing or infringing.
- Copy, reverse engineer or resell DapApp, except where the law lets you.
- Use DapApp to build a competing product or to benchmark it for a competitor.
If you find a security problem, please tell us at [email protected] and give us reasonable time to fix it.
Scheduling and employment law is yours
In shortDapApp is a planner, not legal, HR or payroll advice.
DapApp helps you organize schedules and tasks. It does not give legal, HR, tax or payroll advice, and it does not check your schedules against laws such as overtime, rest-break, predictive-scheduling or youth-labor rules. You are responsible for how you schedule people and for following the laws that apply to your business.
Fees
In shortFree during the beta. We’ll tell you before that changes.
DapApp is free during the beta. If we start charging, we’ll tell you before any charge applies, and you can choose whether to continue or close your account. Nothing is billed unless you agree to it.
Our stuff and your feedback
In shortWe own the product. If you send us ideas, we can use them.
DapApp, including its software, design, text and brand, belongs to us and our licensors. During the beta we give you a limited, revocable, non-exclusive, non-transferable right to use it under these Terms. We reserve all other rights.
If you send us feedback or suggestions, we may use them without restriction and without owing you anything.
Ending things
In shortYou can leave any time. We can end access too, and we’ll delete your data on a set schedule.
You can stop using DapApp and ask us to close your account at any time. We may suspend or end your access at any time, including if you break these Terms, if we need to protect the service or other people, or as part of ending or changing the beta.
After an account is closed, we delete the account’s data within 60 days, and it leaves our backups within 120 days, unless the law requires us to keep something longer. If you want an export of your data, ask us before you close the account.
Sections that by their nature should survive ending (ownership, disclaimers, liability limits, disputes and the fine print) do survive.
No warranties
In shortDapApp comes as it is, and we don’t promise it will be perfect.
DAPAPP IS A BETA AND IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON’T PROMISE THAT DAPAPP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NOT BE LOST.
Limits on our liability
In shortIf something goes wrong, what you can recover from us is limited.
TO THE FULLEST EXTENT THE LAW ALLOWS, DAPAPP AND ITS OWNERS, OFFICERS, EMPLOYEES AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES, EVEN IF WE WERE TOLD THEY COULD HAPPEN.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO DAPAPP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
Some laws don’t allow certain limits. Where that is the case, these limits apply only as far as the law permits. Nothing here limits liability that can’t legally be limited.
If someone makes a claim
In shortIf your content or misuse gets us sued, you help cover it.
You will defend and cover us against claims, losses and reasonable costs (including legal fees) brought by a third party because of Your Data, your use of DapApp in breach of these Terms, or your violation of the law or someone’s rights. We will tell you about the claim promptly, and you may not settle it in a way that admits fault for us without our written consent.
If we disagree
In shortTalk to us first. Arkansas law applies, and disputes go to Arkansas courts.
Please contact us first at [email protected] and give us 30 days to work it out informally.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. If a dispute isn’t resolved informally, it must be brought only in the state or federal courts located in Crawford County, Arkansas, and you and we consent to those courts.
Changes to these Terms
In shortWe may update them. We’ll tell you about changes that matter.
We may update these Terms as the beta and the product change. The version and date at the top show the current one, and the “What’s changed” list shows what moved. For material changes we’ll give you notice by email or in the product at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. If you keep using DapApp after a change takes effect, you accept it. If you don’t agree, stop using DapApp and close your account.
The fine print
In shortThe usual boilerplate that keeps a contract working.
- Whole agreement. These Terms and the Privacy Policy are the entire agreement between us about DapApp.
- If a part fails. If any part is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce something right away, we haven’t given up the right to.
- Assignment. You may not transfer these Terms without our consent. We may transfer them in a merger, sale or reorganization.
- Notices. We can notify you by email to your account address or in the product. Notices to us go to [email protected] and Northwest Arkansas.
- Events beyond our control. We aren’t responsible for delays or failures caused by events outside our reasonable control.
- Electronic agreement. Agreeing online counts as signing, and electronic records of your agreement are valid.
